Companies in U.S. Unlikely to Make COVID Vaccine Mandatory Condition of Employment

Despite having the regulatory backing to make getting the COVID vaccine a mandatory condition of employment, most companies in the U.S. are unlikely to do so for fear of provoking a backlash.

That’s according to a Reuters report, which notes that, “Private U.S. companies have the right under the law to require employees to get vaccinated against COVID-19.”

The Equal Employment Opportunity Commission previously ruled that employees had to get a COVID test before returning to work and this could set the precedent for vaccines.

“Companies have every good reason to get all of their employees vaccinated and also have an obligation to keep all employees and customers safe,” said Lawrence Gostin, a global health law professor at Georgetown University.

However, Robert Field, a law and public health professor at Drexel University, said that companies were in uncharted territory given the rushed approval of the COVID vaccine and its emergency use authorization, which has no precedent.

The Occupational Safety and Health Administration has also previously asserted that employers have the right to mandate vaccines.

Early indications however suggest the vaccine will not be compulsory, with major companies like Ford Motor Co. and Kellogg Co. only offering it on a voluntary basis.

“Companies could theoretically issue a mandate, but in the current political climate it is very unlikely they will do so,” said Peter Meyers, a law professor at George Washington University Law School.

Others point to cases involving infringements on religious freedom which could end up at the newly conservative U.S. Supreme Court.

With polls showing around half of Americans indicating they will not take the vaccine, companies face too stiff an opposition to attempt to make the shot mandatory as a condition of employment.

As we have previously highlighted, in the UK the debate has largely centered around whether bars, restaurants, cinemas and other venues will mandate the vaccination as a condition of entry.

Some airlines have also indicated they will demand digital proof of vaccination before allowing a passenger to fly.

Lord Frost: COVID Restrictions Aren’t Gone Until Masks Are Gone

Lord Frost, who resigned form the government over his opposition to COVID restrictions, asserts that ‘Plan B’ measures in the UK can’t be considered “lifted” until rules on face masks are totally eliminated.

Prime Minister Boris Johnson is expected to announce later today that most Plan B restrictions will end next week.

The measures are being lifted after claims from government advisors that Omicron could lead to 6,000 deaths a death without further lockdown restrictions were proven wildly inaccurate.

However, some reports say that while Johnson will do away with COVID passports and work from home advice, he is planning to keep mask mandates in place.

Lord Frost blasted the plans in a tweet earlier today.

“It is good news if the Cabinet does decide this morning to lift some “Plan B” restrictions,” he wrote.

“But the job isn’t done if mask wearing remains in place. The evidence for masks is weak & the many downsides are persistently discounted.”

“All Plan B measures need lifting *for good*.”

All the measures are supposed to legally sunset on January 26, so whether Johnson will be forced to pass a new vote in parliament to keep mask mandates remains to be seen.

The last time the PM had to get approval for restrictions, he faced a humiliating rebellion from scores of Tory MPs, and can expect a similar fate in even greater numbers if he tries to keep mask rules.

The UK government’s own investigation found that the evidence for the efficacy of face masks stopping the spread of COVID-19 in schools is “not conclusive.”

According to University of Oxford Professor Jim Naismith, when England dropped face mask mandates back in July and Scotland maintained them, it made “no meaningful difference” to infection rates.

We previously highlighted the comments of UK government SAGE adviser Dr Colin Axon, who dismissed masks as “comfort blankets” that do virtually nothing, noting that the COVID-19 virus particle is up to 5,000 times smaller than the holes in the mask.

“The small sizes are not easily understood but an imperfect analogy would be to imagine marbles fired at builders’ scaffolding, some might hit a pole and rebound, but obviously most will fly through,” Axon said.

As we highlight in the video below, other Conservative MPs are warning Johnson that he would be “mad” to keep mask mandates in place.

Australian Authorities Say Draconian Vaccine Passports Could Last For “Years”

Authorities in Western Australia say their draconian new vaccine passport scheme, which bars the unvaccinated from most public places, is likely to be in place for “years.”

Premier Mark McGowan announced the new measures, which will go into effect from the end of the month, as “the broadest proof of vaccination requirements in the nation.”

The vaccine passport mandate will now cover “a wider range of venues.”

“From Monday, January 31, 2022, the vaccine passport mandates will cover cafes, restaurants, dine-in fast food joints, pubs, bars, taverns, clubs, nightclubs, and “all hospitality venues,” as well as private and public hospitals and aged-care facilities,” writes Ken Macon.

Entertainment venues such as “play centers, gaming and gambling, theaters, concert halls, museums, cinemas, and live music venues,” will also be off limits for the unjabbbed.

“Life will become very difficult for the unvaccinated…no pubs, no bottle-shops, no gym, no yoga classes, no gigs, no dance floors, no hospital or aged care visits,” said McGowan, adding that the unvaccinated must be “protected from themselves.”

He added that the rules, which will soon only count people who have had three doses as “fully vaccinated,” will ensure the public is “confident in these public settings, and that they are only mixing with other vaccinated people.”

The restrictions “will not be removed anytime soon” and could be in place “for years.”

Australia has become notorious for becoming the developed world leader in inflicting the most draconian COVID control measures on its population.

As we highlighted last month, Australia’s chief pharmacist Trent Twomey says the public “just need to accept” they will have to take regular vaccine booster shots every six months and continue wearing masks for “many years” to come.

Australia is also building COVID quarantine camps for “ongoing operations,” with one facility at Wellcamp Airport outside Toowoomba not even set to be completed until March.

Citing new strains of COVID and people “who have not had access to vaccination,” Queensland Deputy Premier Steven Miles told the media outlet, “We anticipate there to be a continuing need for quarantine facilities.”
